RIP Fair use?

As the article summarizes, any visual mention of a piece of art, be it in a classroom or online forum or movie parody may not stand the test of the court room. Any company can come after someone who uses one of their images even in a non-commercial way and threaten them with enough lawsuits to stiffle them. Forgetting first ammendment arguments, this could also spell the end to a lot of discussions about popular culture if any part of it doesn’t pass a corporation’s smell test.
